HC stays appointment of an IAS as child commission chairman

The High Court has stayed the government's order to give the additional charge of the post of chairman of the State Commission for Protection of Child Right (RSCPCR) to an IAS officer. 

On February 5, the state government had given the additional charge of the post of chairman of the RSCPCR to , ACS of the Social Justice Empowerment Department. 

The High Court has allowed the state government to appoint another eligible person to the post of chairman. The High Court has given these orders while hearing the petition of former chairperson of RSCPCR Sangeeta Beniwal.

The High Court said that in the Child Protection Act, clear provisions have been given to fill the post of Commission Chairperson. 

As per the provisions, of Women and Child Development Department of Social Justice Empowerment recommends the name of the Child Commission Chairperson. 

What is the argument

Arguing on the petition, advocate Satyapal Chandolia argued that the post of Child Commission Chairperson had fallen vacant due to the resignation of Sangeeta Beniwal. 

On February 5, ACS Kuldeep Ranka of the Social Justice Empowerment Department was given the additional charge of this post, while there is no provision in the to give the additional charge of the Commission Chairman to the IAS officer. The government notification issued in 2020 clearly states that if the post of chairman is vacant, only a senior member of the Child Commission can be given its charge.
