A local court of Deedwana in Rajasthan has ordered the seizure of the vehicles of the collector, SDM and tehsildar in a direct contempt of court.
The court expressed displeasure with the officials for not complying with the court order for 8 years.
What is the case?
This case is related to Waqf Committee in which the court had ordered to register the land in the revenue records. However, officials did not heed to the order and enraged with the negligence of authorities, the court has taken this stern action, which is being seen as a precedent throughout the state.
Advocate Hakam Ali Khan said – This case is of Waqf Committee Deedwana versus the state government. A civil suit was filed in 2003 over the land of the cemetery at Deedwana. In this case, the Rajasthan Waqf Tribunal Jaipur delivered a major judgement on 21 December 2015.
The tribunal recognised that the land of the cemetery mentioned in the gazette notification in Deedwana is the property of the Waqf. Also, the district collector, SDM and tehsildar were ordered to record this land in the revenue records.
The tribunal also directed to make sure that there are no changes or transfers on this in the future, but this judgement has not been followed.
The Waqf Committee filed an ‘Ijrai Petition' in the Additional District Judge's Court in 2016 to enforce the court's decision.
Additional District and Sessions Judge Rajesh Kumar Gajra in his judgement termed the three officers as negligent. The court said that despite issuing repeated orders in the case, which has been pending for 8 years, the administrative authorities were only completing the formalities and trying to postpone the case by taking the next date.
The court clearly said that the officer was wilfully not complying with the order. The judge said that these negligent officials of the administration cannot be given free rein to disobey the orders of the court.
