RPS Divya Mittal gets clean chit in corruption case

Rajasthan government has given a clean chit to Divya Mittal, who is an officer of the Service (RPS) facing corruption charges. 

The (ACB), who had arrested Divya Mittal over allegations of her demanding a bribe of Rs 2 crore from the pharma businessman, failed to produce concrete evidence. The state government turned down prosecution sanction sought by ACB. This has given a big jolt to the reputation of ACB. 

Why the sanction was not given? 

ACB was denied sanction as the agency had not taken approval for action from the government under 17A of the Prevention of Corruption Act. The transcript was also cut and trimmed. Apart from their, ACB in its report did not specify the voice recorded in the transcript despite being confirmed by FSL. Mittal had refused to give her voice sample for matching. 

The ACB failed to produces any converter r wide ce which could prove Mittal guilty. The government sought response from RPS Divya Mittal before turning down ACB's sanction proposal, which had lot of loopholes. 

What is the case?

On May 23, 2021, the Vishwakarma police station in Jaipur had seized a tempo full of medicines worth Rs 5 crores. On next day, police recovered 114 cartons of narcotics from a godown at Transport Nagar in Ramganj, . Following the seizure, police raided places in Noida, Delhi and Kolkata.

The investigation of the Rs 16 crore case was handed over to RPS Divya Mittal, in-charge of the Ajmer post of the SOG.

During investigation, involvement of a Haridwar based pharmaceutical company was found. The company later filed a complaint with the ACB alleging that investigating officer Divya Mittal was demanding a bribe of Rs 2 crore through the sacked constable to get the name removed from the case.

It was alleged that the deal was finalised with the constable for Rs 50 lakh. The first installment of Rs 25 lakh was given to the constable, but the ACB trap failed.

The ACB arrested Divya Mittal on 16 January 2023 on the charge of demanding bribe without the approval under Section 17A of the Prevention of Corruption Act.”

After getting bail, the ACB had registered a case of disproportionate assets against RPS Divya Mittal. In this regard, Divya Mittal alleged before the government that the ACB took action by making fabricated evidence.

Who is Divya Mittal?

Divya Mittal is a 2010 batch Rajasthan Police Service (RPS) officer. Out of her 12 years of active service, she managed her posting in Udaipur for seven years. She was posted in excise department also where she had controversy with liquor traders. She was accused of taking bribe and was later put on APO. After two months, she was posted as Assistant Commandant in Udaipur Khairwada before getting posted as ASP in SOG, Ajmer. 

Live-in relation, love marriage, divorce

Like professional her personal life is also filled with controversies. In June 2014, she had an online interaction over social media with Prateek, who is a CA from Hisar. They used to interact frequently and became friendly.

After three months they both met in Udaipur. Divya's parents were ready for the marriage but Prateek told her that her mother lives in Gurgaon and will have to seek her acceptance before marriage.

Divya and her father Vinod Mittal went to Delhi where they stayed for some days but could not meet Prateek's mother.

Meanwhile Prateek and Divya solemnised a secret wedding at a temple and started living as husband and wife. They decided to do ceremonial wedding after some time. During that period they stayed at various places like Mathura, Bharatpur and Udaipur as husband and wife.

Finally they got formally married. In 2015, Divya's father filed a case of dowry and harassment against Prateek and his family at Hisar Police station. The case continued for few years before they got divorced.
